Judicial Panel to Reconsider Decision That Allowed Trump to Deploy Military Forces to Portland

Appeals Court Agrees to Rehear Case

The ninth circuit court of appeals ruled on this week that it would reexamine the legal dispute concerning the executive power with an larger panel of eleven justices. The court also overturned a previous decision from a three-judge panel that had sided with the federal government.

Legal Saga Over Military Presence

This order represents the most recent development in a long-running court case over whether the former president has the legal right and justification to send state military units in the city. Approximately two hundred troops have been in limbo since the end of September when the mobilization attempt was started in due to ongoing demonstrations.

Differing Viewpoints

The federal government has claimed that government employees at the immigration center in the southern part of the city were under attack, while local authorities assert that municipal police have control of the situation.

In defiance of descriptions of Portland as “war ravaged”, locals have been sharing footage of scenic paths and a thriving food scene, and planning activities such as an protest bicycle event against the increased military presence.

Recent Legal Actions

The Tuesday ruling came after a US district judge in the city issued two temporary restraining orders this period – one blocking the federal control of the state troops, and another stopping the use of any national guard troops in Oregon, after efforts to evade the first order by mobilizing out-of-state forces.

On the previous day, the ninth circuit panel had put the first ruling on hold – allowing command of state troops – but the subsequent injunction remained in place, preventing the actual deployment of the troops.

The latest ruling means the issue will be heard by the full court – with all decisions under consideration simultaneously – by a panel of eleven justices.

“This ruling demonstrates that facts are important and that the courts are striving to ensure government responsibility. The constitution restricts the president’s power, and Oregon’s communities cannot be treated as a testing site for expansive government power,” stated the legal representative in a statement.

“The court is sending a definite signal: the president cannot send the military into US cities without cause. We will continue protecting state legislation, principles, and sovereignty as this case progresses and our legal battle continues in the courts.”
